Examples of our work

Dartford Park

Advising in relation to the development of a large mixed use urban regeneration scheme comprising approximately 100 hectares of mixed uses including a Science Park and up to 1500 new dwellings, leisure uses, primary school, leisure centre, open space and other infrastructure at the former Joyce Green Hospital Dartford.  Involving planning advice on strategy, legal audit of planning application documentation and the Section 106 and other infrastructure agreements relating to physical infrastructure including a bridge over the M25.

Howbury Park

The management of a large planning inquiry relating to rail freight interchange in Bexley with associated distribution development.  Dealt with infrastructure agreements and Section 106 undertakings. Permission granted by Secretary of State on appeal.

Rugby Radio Station Site

Acting on the redevelopment of the Rugby Radio Station site for 6200 dwellings with associated community and social infrastructure and the extension of the Daventry International Rail Freight Terminal.

Edwalton

Acting on behalf of the developers in respect of a site for an urban extension to Nottingham at Edwalton of 1200 dwellings with 28 hectares of employment and social and highway infrastructure.  Dealt with the management of a planning inquiry and related Section 106 agreement. Permission granted by Secretary of State on appeal.

Skegness

Acted for East Lindsey District Council in relation to a residential appeal involving case management, advocacy and the provision of town planning evidence.  This involved a large residential development in Skegness including retail planning advice.

Hartland Park

Case management of a major planning appeal in respect of the redevelopment of the DERA Research Establishment at Farnborough for 4m sq ft of B8 development.  Involving planning advice in relation to strategy, case management of the appeal and subsequent management of High Court challenge.  Also dealt with related infrastructure agreements including Section 106 agreement in relation the appeal. Permission granted by Secretary of State on appeal. Protection of Residential Home

Acting on behalf of occupiers of a park home on the outskirts of a village in Leicestershire who had occupied the park home for 15 years and received an enforcement notice from the local planning authority.  Successfully resisted the enforcement notice and obtained planning permission for the occupants, safeguarding their right to remain.

Cornwall

Acquisition of land from multiple landowners in order to assemble a retail site. This involved the negotiation of conditional contracts and the acquisition of a replacement site for one landowner. Further negotiation of a conditional contract for the disposal of the site to a retail operator for a supermarket of 44,000 sq feet gross internal area together with petrol filling station and car parking.

Stephenson College, Coalville, Leicestershire

Acquisition of land from East Midlands Development Agency and other third parties to assemble site for new college campus.  This involved the acquisition of land from East Midlands Development Agency and     other third parties to assemble site for new college campus and the promotion of the existing college campus for residential planning permission and disposal to residential developer.

South Leicestershire College, Wigston, Leicestershire

£38m college relocation in Leicester, which will see 124,000 sq ft campus constructed on 2.18 acre site. The matter involved the option over the existing college campus.   Purchase of land for new site.   The work also involved purchasing a key area of land from a church institution, advising on planning issues including drafting section 106 agreements, party wall and drainage diversion agreements and dealing with bank security and construction contract requirements.   Promotion of existing college campus for residential planning permission and disposal to residential developer.  

Gateway College, Leicester

£33m college relocation in Leicester, which will see 121,000 sq ft campus constructed on 12 acre site.    This involved the acquisition of land from third parties to assemble site for new college campus.  Selling the existing college campus.  Joint sale of land owned by the college and local authority to leading housing developer. Purchase of land for new site for new college campus.  Infrastructure and wayleave agreements.

The work also involved consideration of potential town and village green issues, advising on planning issues including drafting section 106 agreements and dealing with bank security requirements.

Flooding

Advising a property developer following flooding in Hull in summer 2007. Advising on the duties of the local water authority under the Water Industries Act 1991. Assisting in the preparation of evidence for a local Commission of  Inquiry, and for the governmental inquiry into flooding nationally.

Overhead Electricity Lines

Advising a property developer on a proposal to reroute overhead electricity lines affecting a mixed use development. Advising on a necessary wayleaves application, s37 consent and potential reference for compensation to the Lands Tribunal.

Noise Abatement

Acting for the owner of a vehicle proving and testing ground in a successful appeal against a local authority noise Abatement Notice. The circuit’s facilities are used by key players in the British and international motor industry as well as providers of emergency services vehicles and driver training, the successful outcome of the case protecting their access to adequate testing facilities in this country.

Land Contamination

Acting on the purchase of a former landfill site and adjacent agricultural land, to include advice on the management of environmental risks and liabilities, land stability and the extant waste management licence. Advising on appropriate access arrangements for the (third party) waste management licence holder.
